1. ACCEPTANCE OF TERMS
Welcome to SCartServer.com. P-KOTECH provides its service to you, subject
to the following Terms of Service ("TOS"), which may be updated by us from

2. DESCRIPTION OF SERVICE
P-KOTECH currently provides users with access to shopping cart service,
online store builder, dns service, web site hosting, and branded
programming (the "Service"). You also understand and agree that the
Service may include advertisements and that these advertisements are
necessary for P-KOTECH to provide the Service.
You understand and agree that the Service is provided "AS-IS" and that P-KOTECH
assumes no responsibility for the timeliness, deletion, mis-delivery or
failure to store any user communications or personalization settings.
In no event shall the P-KOTECH services, company, owners,
or employees, be liable to any party for direct, indirect, special,
incidental, or consequential damages arising out of the use of the P-KOTECH
services, hardware, software, its documentation, or any derivatives
therefore, even if the authors, owners, or employees have been advised of
the possibility of such damage.
3. YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the Service, you represent that you are of
legal age to form a binding contract and are not a person barred from
receiving services under the laws of the United States or other applicable
jurisdiction. You also agree to: (a) provide true, accurate, current and
complete information about yourself as prompted by the Service's
registration form (such information being the "Registration Data") and (b)
maintain and promptly update the Registration Data to keep it true,
accurate, current and complete. If you provide any information that is
untrue, inaccurate, not current or incomplete, or P-KOTECH has reasonable
grounds to suspect that such information is untrue, inaccurate, not
current or incomplete, P-KOTECH has the right to suspend or terminate your
account and refuse any and all current or future use of the Service (or
any portion thereof).
4. PRIVACY POLICY
Registration Data and certain other information about you is subject to
our Privacy Policy.

5. MEMEBER ACCOUNT, PASSWORD AND SECURITY
You will receive a password and account designation upon completing the
Service's registration process. You are responsible for maintaining the
confidentiality of the password and account, and are fully responsible for
all activities that occur under your password or account. You agree to (a)
immediately notify P-KOTECH of any unauthorized use of your password or
account or any other breach of security, and (b) ensure that you exit from
your account at the end of each session. P-KOTECH cannot and will not be
liable for any loss or damage arising from your failure to comply with
this Section 7.6. MEMBER CONDUCT
You understand that you, and not P-KOTECH, are entirely responsible for
all Content that you upload, post, or otherwise make available via the
Service. Under no circumstances
will P-KOTECH be liable in any way for any Content, including, but not
limited to, for any errors or omissions in any Content, or for any loss or
damage of any kind incurred as a result of the use of any Content posted,
or otherwise made available via the Service.
Pornography and sex-related materials are prohibited on
all servers. This includes links to pornography and sex-related
merchandising.
Any attempts to undermine or cause harm to a server or any of the contents
on the server is strictly prohibited. Any violation will result in
immediate deactivation of services without refund. P-KOTECH reserve the
right to determine what violates this policy.
7. PRICING AND FEES
Listed Packages and Pricing may change at any time without notice. If you
have chosen to pre-pay account fee, the cost of the service already paid
for will not be affected by any price changes whether they are raised or
lowered. A 30-days prior notice is required for all account cancelation.
P-KOTECH reserves the right to cancel the Service at any time. All fees
paid in advance of cancellation will be pro-rated and refunded by P-KOTECH
to customer if P-KOTECH initiates its right of cancellation and customer
is NOT in violation of these Terms and Conditions. If cancellation is
caused by customers and/or its client's breach of the Terms and
conditions, then customer agrees that no refund is due. Customer
understands that the Service can be cancelled at any time effective the
end of the contract.
8. SPECIAL ADMONITIONS FOR INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree to comply with
all local rules regarding online conduct and acceptable Content.
